How to Use This Form

Part A – Cast Member Release and Media Assignment

This Release and Media Assignment ("Release") is made as of ________________ ("Effective Date") by the undersigned ("Signer") in favor of Jesus Christ's Truth, Restoration, and Prayer House, a California nonprofit religious corporation, PO Box [TBD], California (the "Church"; also known as JC's TRAP House).

1. Grant of Name, Likeness, and Life-Story Rights. Signer gives the Church written consent under California Civil Code §3344, and grants the Church the perpetual, worldwide, irrevocable (except as stated in Section 11), royalty-free right to use Signer's name, image, likeness, photograph, voice, signature, biography, and life story ("Likeness"), in all media now known or later developed, including church services, the Church website, YouTube, social media, films, livestreams, fundraising, and promotional material, and in related advertising for the Church's ministry. The Church may sublicense these rights to its distributors and platforms only to carry out Church uses.

2. Assignment of Copyright. Signer assigns, transfers, and conveys to the Church all right, title, and interest, including all copyrights, renewals, and extensions, in all photographs, video, audio, writings, artwork, and other media that Signer creates or provides to the Church in connection with any Church production, ministry, or event ("Materials"). This is a signed written transfer under 17 U.S.C. §204(a). It is an assignment, not a work-made-for-hire agreement. Signer will sign any further documents reasonably needed to record or confirm this assignment.

3. Moral Rights; License-Back. To the extent the law allows, Signer waives, and agrees not to assert, any moral rights, rights of attribution or integrity, or similar rights (including under 17 U.S.C. §106A and Cal. Civ. Code §987, where applicable) in the Materials. The Church grants Signer a non-exclusive, non-transferable, royalty-free license to use Signer's own Materials for personal, non-commercial purposes (such as a personal portfolio or family sharing), as long as the use does not suggest Church endorsement or compete with Church distribution.

4. Signer Warranty. Signer warrants that Signer created the Materials or has the right to provide and assign them; that they do not infringe anyone's copyright, trademark, privacy, or publicity rights; and that Signer has written permission from any other identifiable person shown in Materials Signer provides (or will tell the Church in writing that permission is missing).

5. Survival After Death; Binding on Heirs and Estate. This Release continues after Signer's death. It binds Signer's heirs, executors, administrators, successors, assigns, and estate, and any person who later holds Signer's deceased-personality rights under Civil Code §3344.1. Signer expressly consents, during Signer's lifetime, to the Church's use of Signer's Likeness and Materials in a future obituary, memorial, tribute, or remembrance content, under the same respect and privacy rules in Sections 7 and 8. Signer intends this to be a lifetime written transfer and consent under §3344.1. A digital replica after death still requires the separate opt-in in Schedule 2.

6. Volunteer; No Compensation; No Employment. Signer participates as an unpaid volunteer for religious and charitable purposes, with no expectation of pay. No wages, fees, royalties, or back pay are owed, now or later, including after the Church reaches its $110,000 Funding Milestone; any future paid role requires a separate written agreement approved under the Bylaws. Nothing in this Release creates an employment, agency, partnership, or contractor relationship. Signer will not file for workers' compensation or unemployment benefits based on this Release.

7. Editing and Authentic Portrayal. The Church may edit, crop, combine, caption, translate, and arrange the Likeness and Materials. The Church will not use them in a false, misleading, or demeaning way, or in a way that places Signer in a false light. Characters and persons are shown authentically and with respect for their dignity and testimony.

8. Privacy and Sensitive Details. The Church will use sensitive details, such as health, medical or mental-health history, addiction or recovery, criminal history, immigration status, finances, or family history, only with Signer's separate written OK for that specific use (initial here to give it now: ______ for the uses described: ______________________________). The Church follows its Privacy Statement Rev1.

9. Release of Claims. Signer releases the Church, its directors, officers, volunteers, and Digital Staff from claims for invasion of privacy, right of publicity, and defamation that arise from uses permitted by this Release and from authentic, accurate portrayal. This release does not cover uses that breach Sections 7 or 8, or the Church's gross negligence or willful misconduct. [COUNSEL: Civil Code §1542 waiver intentionally not included in this draft; see Drafter's Notes. If counsel adds it, use the full statutory text in bold and a separate initial line.]

10. Production Credit. Where production credits are given, the Church may credit Materials and crew work as "JC's TRAP House Digital Staff." The Church is not required to give individual credit, but may do so at its discretion.

11. No Revocation of Published Content; Good-Faith Requests. Signer cannot revoke consent for content already published or distributed. Signer may ask in writing (to PO Box [TBD] or through jcstraphouse.org) that the Church stop future uses. The Church will consider the request in good faith and with pastoral care, and will tell Signer its decision, but is not required to remove existing content.

12. General. California law governs. This is the entire agreement on its subject; changes must be in writing signed by both parties. If any part is unenforceable, including any digital replica term, the rest remains in effect. Electronic signatures and copies are as valid as originals. Signer has read this Release, had the chance to ask questions and consult a lawyer, and signs voluntarily.

13. Electronic Acceptance; Unsigned Submissions. (a) Electronic signature. An adult Signer may accept Part A electronically by (i) checking a required, unchecked-by-default box reading "I have read and agree to the Cast & Obituary Likeness Release and Media Assignment", next to a link to the full text of this Release, and (ii) typing Signer's full legal name and the date. That act is Signer's electronic signature, adopted with intent to sign, and is valid under the California Uniform Electronic Transactions Act (Civ. Code §1633.1 et seq., including §1633.7) and E-SIGN (15 U.S.C. §7001 et seq.). The parties intend it to be the signed writing required by 17 U.S.C. §204(a) and the written consent required by Civ. Code §3344. (b) Record. The Church keeps a record of each acceptance: typed name, email, date and time (with time zone), the Release version accepted (see Version Log), the submission it covers, and the form used; and will give Signer a copy on request. (c) Unsigned submissions. Media submitted without a completed electronic or handwritten signature is not assigned to the Church. Instead, by submitting it, the submitter grants the Church a non-exclusive, perpetual, worldwide, royalty-free license to use, edit (subject to Sections 7 and 8), display, and distribute that submission for the Church's ministry, and consent to show the submitter's likeness only as it appears in that submission. No other Likeness, life-story, or assignment rights pass. (d) Not by checkbox alone. Minors (Schedule 3), deceased persons (Schedule 1), and any digital replica or AI use (Schedule 2) cannot be accepted by checkbox; each requires its own signed and initialed schedule. (e) Changes. A later version of this Release does not apply to past acceptances unless the Signer accepts it.
